what happens after a federal tax lien withdrawal denied?

I have an OIC pending, the IRS did not know that due to backlog, they filed a Fedral Tax lien, I submitted a request to withdraw but was denied. They sent a levy notice and I called and they found out that I have an OIC pending so they put a hold on the collection, what would their next step after teh withdrawal denial be? Would they levy or they will keep the hold tilla decision is made on teh OIC?

  1. There is nothing that requires IRS to withhold filing a Notice of Federal Tax Lien while an offer is being considered. In fact, the canned letter acknowledging receipt of the offer states a notice of lien may be filed anyway. If your offer is accepted, the lien will be released when you pay the agreed amount.
  2. When you say the OIC is pending, that usually means that the offer has been received and is under consideration. Unless you filed for the OIC separately on a joint return, your account should be placed in a status that prevents any levy or lien action--so I'm not sure what's going on. Have you received verification that the OIC has been received?
